Women's Healthcare Choices:

What choices are left for privacy as the fight renews over Roe v. Wade.


I am going to start this one off with a couple simple questions for everyone:

            Which one makes you madder; 
            The SCOTUS draft was leaked?
            Or the content of the leaked draft that earned your ire?

Speaking just for myself I have no sympathy for the Supreme Court. Something that has been accepted as law/right/guarantee for nearly 50 years and should have fallen under the Stare Decisis and therefore would  have been untouchable has been stripped from American families. The choice of when to start a family should be up to the family and not the courts at any level. 

Do I believe that all abortions should be illegal, NO, unequivocally! Outlawing abortion is taking away the rights of family members to make safe decisions that can have negative impacts on low income families of all different ethnic groups. They have started with a woman's right to self determination of healthcare needs despite opinions of some 60% plus of our citizenry, who also believed that this was settled issue.  You can bet your collective asses that this decision by the highest court is a gateway to other undefined rights.

Special circumstances do exist that can have a sad impact on the pregnant minor/woman. If the pregnancy is the result of sexual assault, which in my mind also includes incest then this is clear enough grounds for abortion to be kept legal. Secondly, if the pregnancy is determined to be one that will have a serious affect on the life of the unborn child or mother then this can also necessitate an abortion.

Why does the supreme court deserve a cloak of invisibility over their daily business when the other two branches are not afforded the same courtesy? We do hear about the leaks coming from the congress and white house, why should the court be any different? On occasion we get told what is going on by our elected officials, whom by the way, work for us. So in essence the court is or should be open to the inspection of actions taken and decision by them that are supposedly in our best legal interest. To this I feel the need to call BULLSHIT!! They are the highest court in the land and, again, in my opinion they are no different from any other branch and should be treated the same as the other two branches. 

To be honest I have been skeptical of the legal system in this country my entire free thinking life which began in my late teens. When someone with high powered legal teams can get away with murder, embezzlement, extortion or other felonious acts gets acquitted, and someone who cannot afford anything more than a public defender, (this includes the people who fall financially in the range where they can barely make ends meet) will be convicted, whether guilty or not simply because of their skin tone. 

Then there are the situations where a white or otherwise privileged person has been tried for and convicted on more than count and is sentenced to multiple terms that are run concurrently, where a person of color or lack of finances has been tried and convicted for the same crimes receives a sentence to multiple terms which more often than not will be run consecutively. Fair? Equitable? I don't think so, do you?

I will bet you any number of push-ups that they will be coming after birth control of all types next. This is when the question becomes does the man's right to make a conscious decision about whether he wants to become a father immediately upon marriage and has a reversible vasectomy. Will this be allowed? A woman who has had two children and does not want any more, will her right to have a tubal ligation be voided? Say good bye to over the counter contraceptive sales. 

I hope to be proven wrong, but only time will tell.

I don't ask that you agree with me, as a matter of fact, I don't expect anyone to agree with any opinion I put forth in this essay. All I do ask is that you at least take a few minutes to consider what has been written here as to whether it makes sense to you.

Afterthought:

Just in case you didn't understand the term Stare Decisis here is the legal definition:

               The legal principle of determining points in litigation according to precedent.

Here is the Constitutional definition:

 Stare decisis is a principle of policy, not a mechanical formula of adherence to the latest decision however recent and questionable, when such adherence involves collision with a prior doctrine more embracing in its scope, intrinsically sounder, and verified by experience.

This is just my opinion but I do however, believe this applies to Roe v. Wade as well as Planned Parenthood of Southeastern Pennsylvania v. Casey.

What's next on the trump party agenda? I wonder, don't you? If not why not?
